These Program Terms & Conditions (“Agreement”) govern the SMS and  Search Engine Optimization (“SEO”) services provided by Higher Site Group, Inc. (“Higher Site”, “we”, “our”, or “us”) to the Client (“Client”, “you”, or “your”). By engaging our SEO services, you agree to these terms.

Higher Site Group Appointment Alerts

By opting in to receive SMS messages from Higher Site Group, Inc., you agree to receive recurring non-marketing text messages concerning appointments you request. Messages may include appointment confirmations, reminders, rescheduling or cancellation notices, and other customer-care updates directly related to your requested appointment.

Consent to receive SMS messages is not a condition of purchasing any goods or services.

Message Frequency

Message frequency varies based on your interactions and scheduled appointments.

Message and Data Rates

Message and data rates may apply. Contact your wireless carrier for information about your text-messaging or data plan.

Opting Out

You may cancel the SMS service at any time by replying STOP to any message from us. After you send STOP, you will receive a confirmation message that you have been unsubscribed. You will then receive no further SMS messages from this program unless you opt in again.

Rejoining the Program

After opting out, you may rejoin by completing our website opt-in process again or by using another opt-in method expressly offered by Higher Site Group, Inc.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. SMS delivery is subject to effective transmission by your wireless carrier and is outside the control of Higher Site Group, Inc.

Supported Carriers

Availability of SMS messaging may vary by wireless carrier and mobile device. Not all carriers or devices may support every messaging feature.

Privacy

We respect your privacy. Mobile information and SMS opt-in consent will not be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with service providers solely as necessary to operate and support our messaging program.

Higher Site Group, Inc. may update these SMS Terms & Conditions periodically. Changes will be published on this page with an updated revision date. Your continued participation in the SMS program after an update constitutes acceptance of the revised terms.

SEO

1. Scope of Services

Higher Site provides ongoing SEO services, which may include:

  • SEO strategy and planning
  • Website SEO audits
  • Keyword research
  • On-page optimization
  • Technical SEO improvements
  • Local SEO optimization
  • Content recommendations and optimization
  • AI Search Optimization
  • Link building and digital authority campaigns
  • Google Business Profile optimization
  • Monthly performance reporting
  • Ongoing SEO consultation

The exact deliverables are outlined in your proposal or service agreement.

2. No Guaranteed Rankings

Search engines use proprietary algorithms that change frequently.

Accordingly, Higher Site does not guarantee:

  • First-page rankings
  • Specific keyword rankings
  • Organic traffic increases
  • Number of leads
  • Revenue increases
  • AI Search visibility
  • Featured snippets
  • Google Business Profile rankings

SEO is a long-term marketing strategy and results vary depending on competition, website history, industry, and search engine updates.

3. Expected Timeframe

SEO typically requires ongoing optimization.

While some improvements may occur within the first few months, meaningful results often take 3–6 months, with more competitive industries requiring 6–12 months or longer.

4. Client Responsibilities

The Client agrees to:

  • Provide timely access to websites, hosting, CMS, Google accounts, analytics, and advertising platforms when required.
  • Respond to requests for approvals or information promptly.
  • Notify Higher Site before making significant website changes.
  • Maintain active hosting and domain registration.
  • Ensure all business information supplied is accurate.

Delays caused by the Client may impact SEO performance and project timelines.

5. Website Changes

Higher Site may recommend technical or content changes.

Unless otherwise agreed:

  • recommendations requiring development may incur additional charges;
  • third-party software, plugins, or licenses are billed separately;
  • the Client is responsible for approving significant website changes.

6. Content

SEO content created by Higher Site is intended to improve search visibility.

The Client is responsible for:

  • reviewing all published content;
  • ensuring industry-specific or legal accuracy;
  • confirming compliance with applicable regulations.

7. Search Engine Updates

Google, Bing, AI search engines, and other platforms frequently update their ranking systems.

Higher Site is not responsible for:

  • algorithm updates;
  • ranking fluctuations;
  • manual actions caused by prior SEO work;
  • loss of rankings resulting from search engine changes.

We continually adjust strategies as industry best practices evolve.

8. Third-Party Services

SEO performance may depend on third-party platforms including:

  • Google
  • Bing
  • OpenAI search experiences
  • Apple Maps
  • Google Business Profile
  • WordPress
  • hosting providers
  • DNS providers
  • analytics platforms

Higher Site is not responsible for outages, policy changes, account suspensions, or technical issues involving third-party services.

9. Backlinks

Where link building is included:

  • Higher Site seeks high-quality, editorially appropriate backlinks.
  • Placement on third-party websites cannot be guaranteed permanently.
  • External websites may remove or modify backlinks at any time.

10. Reporting

Monthly reports may include:

  • keyword rankings
  • organic traffic
  • impressions
  • clicks
  • conversions
  • completed SEO work
  • upcoming recommendations

Reports are based on available third-party data sources.

11. Intellectual Property

Upon full payment:

  • Client-owned website content remains the Client’s property.
  • Original SEO content produced by Higher Site becomes the Client’s property unless otherwise stated.

Higher Site retains ownership of:

  • proprietary SEO methodologies
  • templates
  • internal processes
  • software
  • automation systems

12. Confidentiality

Both parties agree to maintain the confidentiality of:

  • login credentials
  • business information
  • customer data
  • pricing
  • proprietary strategies

unless disclosure is required by law.

13. Payment

SEO services are billed according to the agreed proposal.

Unless otherwise stated:

  • invoices are due upon receipt;
  • overdue invoices may result in suspension of SEO work;
  • late payments do not extend the service period.

14. Cancellation

Either party may terminate the SEO program by providing 30 days’ written notice, unless otherwise specified in the signed proposal.

Fees already paid are non-refundable.

Any work completed prior to cancellation remains billable.

15. Limitation of Liability

To the maximum extent permitted by law, Higher Site shall not be liable for:

  • loss of rankings;
  • loss of traffic;
  • loss of revenue;
  • indirect or consequential damages;
  • business interruption;
  • search engine penalties resulting from Client actions or
  • prior SEO performed by others.

Higher Site’s total liability shall not exceed the amount paid by the Client for SEO services during the preceding three (3) months.

16. Force Majeure

Higher Site shall not be liable for delays caused by events beyond our reasonable control, including natural disasters, internet outages, cyberattacks, governmental actions, labor disputes, or widespread technology failures.

17. Governing Law

This Agreement shall be governed by the laws applicable in the jurisdiction where Higher Site Group, Inc. operates, unless otherwise specified in the service agreement.

18. Acceptance

By purchasing, continuing, or renewing SEO services with Higher Site Group, Inc., the Client acknowledges that they have read, understood, and agree to these Terms & Conditions.
